Abstract

This article examines the current limitations of U.S. information privacy laws in regulating artificial intelligence (AI) systems. It argues that the sectoral nature of American privacy regulation has resulted in substantial gaps concerning AI-generated data, automated decision-making, and algorithmic opacity. The paper proposes a policy framework for integrating AI-specific privacy safeguards into U.S. law.
