Comparative Analysis of the TRIPS Agreement and Intellectual Property Legislation in the Republic of Uzbekistan
Main Article Content
Abstract
This paper presents an in-depth comparative analysis of the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS) and the intellectual property (IP) legislation of the Republic of Uzbekistan. The primary objective of this research is to examine the extent of conformity between Uzbek IP laws and TRIPS, with a focus on trademarks, enforcement measures, and legal protection mechanisms. Through a comprehensive analysis that includes a detailed comparative table, we identify both areas of convergence and divergence, while outlining key reforms necessary for Uzbekistan's full compliance with international standards. The analysis reveals substantial alignment in some areas but also highlights significant shortcomings in criminal enforcement and border measures. Recommendations are provided to address these gaps, which are essential for Uzbekistan's accession to the World Trade Organization (WTO).
